This note explains the terms on which the photographs published on this site may be used, and how to obtain a licence to use them.
All photographs on this site were created by Piotr Korczyński. They are works within the meaning of the Polish Act of 4 February 1994 on Copyright and Related Rights and are protected from the moment they are fixed. All rights reserved. Publishing a photograph on this site does not grant a licence to use it in any way.
This page is an informational note, not terms of service. It does not limit the rights granted to you by statute under permitted use (including Articles 23, 29 and 33 of the Polish Copyright Act).
Whenever you rely on permitted use, credit the photograph as “fot. Piotr Korczyński” and give the page address.
The authorship credit, the watermark and the metadata are protected — removing or circumventing them infringes the law (Article 16 and Article 79(6)–(7) of the Polish Copyright Act).
I expressly reserve the right of text and data mining within the meaning of Article 26³ of the Polish Copyright Act (implementing Article 4 of Directive (EU) 2019/790). Using photographs from this site to train, fine-tune or validate machine learning models and AI systems is prohibited.
This reservation is an express opt-out from TDM and is also expressed in machine-readable form: in robots.txt, in the /.well-known/tdmrep.json file, in HTTP headers served with the image files, and in the meta tags of the pages. It applies both to automated collection of the photographs and to the use of datasets containing them.
Licences are granted individually. The fee is set for the specific photograph and the intended use. Prints are not sold through this site.
Every licence sets out in writing the permitted uses, the term, the territory, the fee and the required authorship credit. Write to p.korczynski@planetarecykling.pl or use the contact form — tell me which photograph you mean and how you intend to use it.
Enquire about a licenceSome photographs were taken at events for which I held accreditation. The terms of that accreditation, or the rights of the organiser, may restrict further use of those photographs, and the image rights of the people shown apply as well. The scope of any possible licence for such photographs is confirmed individually.
Some photographs show people at public events. I publish them as part of artistic and informational activity, relying on the exceptions in Article 81(2) of the Polish Copyright Act (persons holding public office, and persons forming merely a detail of a whole — a gathering or a public event).
If you recognise yourself in a photograph and do not want it published, write to p.korczynski@planetarecykling.pl — I will consider your request and remove the photograph from the site unless there are grounds for continuing to publish it.
If you see one of my photographs being used without permission, let me know: send the page address and a screenshot to p.korczynski@planetarecykling.pl. Infringements are first referred for takedown and, where warranted, pursued under Article 79 of the Polish Copyright Act.
